These terms (“Seller Terms”) govern your use of the website as a seller of media files only (images, audio, video, animations, or other digital media). By creating a seller account and clicking “I agree,” you agree to be bound by these terms.
2. Changes to Terms
2.1 CRC may change, amend, update, or replace these Seller Terms at any time, for any reason, without notice.
2.2 Any change takes effect immediately upon publication on the website. You are responsible for staying familiar with the current version. Continued use of CR Stock constitutes acceptance of the updated terms.
2.3 CRC may change, restrict, suspend, or discontinue any feature of the website at any time.
3. CR Stock Services
3.1 CR Stock is a digital marketplace. When you buy or sell a media file, the contract is strictly between the buyer and the seller. CRC is not a party to that contract.
3.2 We act solely as an intermediary to facilitate digital transactions.
3.3 CRC is not liable for:
– The quality, legality, accuracy, or purpose of any media sold by a seller.
– A seller failing to deliver a media file.
– A buyer failing to pay.
3.4 CR Stock services are non‑exclusive and CRC may provide services to others.
3.5 CRC may provide APIs or features but does not guarantee availability.
3.6 Prohibited Media Content:
– Illegal content under NZ law.
– Harmful, abusive, hateful, discriminatory, or violent content.
– Copyright‑infringing or IP‑violating content.
– Misleading, deceptive, or fraudulent media.
3.7 Restricted Media Content (requires CRC approval):
– Explicit adult content.
– Financial advice media.
– Medical, health, or therapeutic claims.
CRC may remove any content or suspend accounts for violations.
4. Registration
4.1 You must register with accurate and current information.
4.2 You are responsible for all activity on your account and must keep login details secure.
4.3 You may only sell digital media files that comply with NZ law and all platform rules.
4.4 You must not upload or sell:
– Media you do not own or have rights to.
– Misleading descriptions.
– Inappropriate, harmful, or restricted media.
5. Listings
5.1 Sellers must ensure:
– Prices are in NZD and include GST where applicable.
– Media descriptions are accurate and not misleading.
– Categories chosen are appropriate.
– You own copyright to all uploaded media.
– Your media does not breach these terms.
5.2 You grant CRC a licence to use your media previews for platform functionality and marketing.
6. Fees and Payment
6.1 CRC charges a 20% commission per sale. This may be changed at any time.
6.2 Payments are processed through Stripe. You must agree to Stripe’s terms.
6.3 CRC has no control over Stripe’s processing times.
7. Delivery of Digital Media
7.1 All media files must be delivered digitally via the CR Stock system.
7.2 You must ensure the file is accessible, functional, and matches its description.
8. Disputes
8.1 Sellers must work directly with buyers to resolve disputes.
8.2 Refunds must follow your displayed refund policy.
8.3 Disputes with CRC must be raised directly.
9. Termination
9.1 CRC may terminate any seller account at any time, without notice, for any reason.
9.2 You may close your account with two weeks’ notice.
9.3 Termination does not remove responsibility for completed or pending transactions.
9.4 No refunds or compensation are provided upon termination.
10. Privacy
CRC complies with the NZ Privacy Act 2020. Personal information is used only for administering accounts, listings, payments, and platform operations.
11. Liability
CRC is not liable for any loss including lost profits, reputation, data, disputes, misuse of media, or platform downtime. You use CR Stock at your own risk.
12. Jurisdiction
These terms are governed by New Zealand law.
13. General
13.1 Notices may be sent by email.
13.2 You may not assign any rights under these terms.
13.3 Sellers are independent and not employees or agents of CRC.
